ACCEPTABLE USE POLICY
It is important to us that our customers use our
services and the Internet in general, responsibly and courteously. Most
of our customers do so and seldom need to refer to these AUPs.
Nonetheless, the following constitute examples of unacceptable uses of
Websuvidha.com’s services, which will result in suspension, or termination
of the customer’s account.
By using our webhosting services, you agree to comply with our policies. You are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. We expect you to have a basic knowledge of how the Internet functions, the types of uses which are generally acceptable, and the types of uses which are to be avoided. Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses:
Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S.
and International export restrictions, harassment, fraud, spamming, trafficking in obscene material, drug dealing, and other illegal activities.

AFFRONTS TO ETIQUETTE
Unacceptable activities include spamming (sending
unsolicited advertising to those with which the customer has no existing
business relationship, posting off - topic advertising in (newsgroups);
spoofing (using a return email address which is not the valid reply
address of the sender or sending an email message which does not
contain enough information to enable the recipient to identify the
party who is really sending the message; passive spamming (promoting a
web site hosted by Websuvidha by spamming from some other source),
trolling (posting controversial messages in newsgroups to generate
responses), mail bombing (inundating a user with email without any serious
intent to correspond), and subscribing someone else to an electronic mailing
list without that person's permission. This also include sending an
unsolicited email message using any other service provider's email account and
in turn advertising about a website hosted on websuvidha.com's server is also
unacceptable.

Illegal Use
Websuvidha.com servers may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: "Pirated software", "Hackers programs or archives", "Warez Sites", "Irc Bots", "Mp3".
Websuvidha.com further reserves the right to suspend or terminate service to any websites affiliated with known or suspected terrorist organizations at our discretion.
We will be the sole arbiters as to what constitutes a violation of this provision.

System and Network Security
Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting.
It is a violation for anyone who, including but not limited to, employs posts or programs which consume excessive CPU time or storage space, permits the use of mail services, mail forwarding capabilities, POP accounts, or auto responders other than for their own account; or resale of access to CGI scripts installed on our servers.

Tortious Conduct
No one shall post defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights..

Spamming
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is expressly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial E-mail or spam.
It is contrary to Websuvidha.com policy for customers to use our servers to effect or participate in any of the following activities:.

To post to any Usenet or other newsgroup, forum, e-mail mailing list or other similar group or list articles which are off-topic according to the charter or other owner-published FAQ or description of the group or list;

To send unsolicited mass e-mailings, if such unsolicited e-mailings provoke complaints from the recipients;

To engage in any of the foregoing activities using the service of another provider, but channeling such activities through a websuvidha.com provided server, or using a websuvidha.com provided server as a maildrop for responses;

To falsify user information provided to websuvidha.com or to other users of the service in connection with use of a websuvidha.com service.

When websuvidha.com becomes aware of an alleged violation of its Acceptable Use Policy, websuvidha.com will initiate an investigation (within 24-48 hours). During the investigation websuvidha.com may restrict Customer 's access in order to prevent further possible unauthorized activity. If the Customer is found in violation of our SPAM policy, websuvidha.com may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies. Also, websuvidha.com reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. If such violation is a criminal offense, websuvidha.com. will notify the appropriate law enforcement department of such violation.

websuvidha.com does not issue service credits for any outages incurred through service disablement resulting from Policy violations.

The Customer shall be held liable for any and all costs incurred by websuvidha.com as a result of the customer's violation of these terms and conditions. This is including, but is not limited to, attorney fees and costs resulting from Postmaster responses to complaints from and the cleanup of unsolicited commercial mailings and/or unauthorized bulk mailings and/or news server violations. First violations will result in a Cleanup Fee of $500 and the customer’s account will be reviewed for possible immediate termination. Each subsequent violation thereafter will result in Cleanup Fee of $1000 and immediate termination of the customer’s account. The Customer who violates this policy agrees to also pay Investigation Fees of no more than $250 per hour that websuvidha.com personnel must spend to investigate any violations.

Modification
websuvidha.com reserves the right to add, delete, or modify any provision of this Policy at any time without notice. Reporting Network Abuse Any party seeking to report any violations

ACCOUNT OWNERSHIP
Websuvidha is only responsible to the present owner of
the Web hosting space. We verify ownership by credit card number (if paid for
by credit card), name, address, email address, username, & password. If you
give this information to any other party or give access to your email address
on your account to another party, you risk having your Web site and any other
information on your account changed and/or deleted. We are not responsible for
any information on your account should you reveal this information to another
party who causes damage to your account and/or Web site.

No guarantees are made of
any kind, either expressed or implied, as to the integrity of these backups.
Backups are made for server restoration purposes only. It is the clients'
responsibility to maintain local copies of their web content and any
information on their account including but not limited to clients website,
email, databases, mailing lists, and archives. If data loss occurs due to
negligence of client in securing their account or by an action of the client, Websuvidha will not be responsible.

PAYMENT POLICIES AND FEES
Full payment is required before any hosting service is
rendered, which includes renewals. All payment-due notices will be sent by
electronic mail. No bills or invoices will be sent by postal mail or fax.
Prepayment is due each anniversary (one month, or one year) following the date
the account was established. Additional features can be added at any time.

RESELLERS
You must follow our steps to becoming a reseller. For
more information go to our Resellers Page. You provide billing to your
customers. We do not bill your customers. We bill you for the domain name and
space, then you in turn bill them for your cost from us and your services in
addition to that.
Actual or attempted violations of policy by a customer's
end user shall be considered violations of the policy by the customer
regardless of intention and will be acted upon accordingly.
Your customers are given a limited amount of transfer and
if we feel that one of your customers are using up more transfer than
allocated or are taking up too much of the CPU usage then we will need to pass
some of the extra cost on to you and you will need to pass it on to your
customer. You will need to put that in your terms and conditions for the
hosting.
You agree that neither you nor your customers can hold us
responsible for services that you offer. Your customers have to abide by the
same terms and conditions as you do, or we have the right to cancel any of
your reseller accounts.
If you abuse our services, we reserve the right to cancel
your account, which will also cancel your customers accounts.
We reserve the right to remove the link to a reseller's
Web site on our Web Design page if it has been determined that the reseller is
affiliated in any way with a competitor of Websuvidha, if it has been
determined that the reseller is not representing Websuvidha professionally or
appropriately, or if it has been determined that the reseller has violated our
Acceptable Use Policy.

ABUSE OF THE LEGAL RIGHTS OF OTHERS
Examples of unacceptable activities in this regard
include posting private information about a person without their consent,
infringing intellectual property rights, defaming a person or business,
and knowingly making available code which will have a deleterious
effect on third party computers. Websuvidha supports free speech on the
Internet, and will not suspend or cancel a customer’s account simply
because it disagrees with the views expressed by the customer. Where there
are allegations that a customer’s on-line activity has violated the legal
rights of a third party, Websuvidha will not substitute itself for a
court of law in deciding tort claims raised by the third party.

ABUSE OF LAW
Websuvidha’s services may be used for lawful
purposes only. Illegality includes but is not limited to drug dealing,
attempting without authorization to access a computer system, pirating
( distributing copyrighted material in violation of copyright law ),
gambling, schemes to defraud, trafficking in obscene material,
violating U.S. / INDIAN export restrictions, stalking, or violating
other state or federal law such as the Electronic Communications Privacy
Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act.

PORNOGRAPHY
Pornography and sex-related merchandising, even if
legal, is not an acceptable use of Websuvidha’s servers.

ABUSE OF WEBSUVIDHA'S SERVER RESOURCES
Running programs in the background on a
Websuvidha’s server without Websuvidha’s prior written authorization, or
running chat rooms, Internet Relay Chat, IRC bots, Spamming, and the like
are not acceptable uses of Websuvidha’s servers. Websuvidha shall be
the sole arbiter of what is and is not a violation of these acceptable use
policies. Websuvidha reserves the right to terminate an account at any
time and for any reason that causes harm to other Websuvidha customers.
Limitation of Liability. Websuvidha shall
not be responsible for any claimed damages, including incidental and
consequential damages, which may arise from Websuvidha’s servers going
off - line or being unavailable for any reason whatsoever. Further,
Websuvidha shall not be responsible for any claimed damages, including
incidental or consequential damages, resulting from the corruption or deletion
of any web site from one of Websuvidha’s servers. All damages shall be
limited to the immediate termination of service.
